Jose Fernando Morales Killed After Tow Truck Rolls Over Him

CHINO, California ? Mechanic Jose Fernando Morales, 47, of Santa Clarita was killed Monday afternoon when the disabled tow truck he was working on rolled over on him in the 4700 block of Chino Avenue, according to the San Bernardino County Sheriff Coroner?s office.

Chino Valley Fire Department paramedics pronounced Morales dead at the scene of the accident about 3:39 p.m. The Chino Police Department is investigating the circumstances that led to the man?s death.

It was not clear whether Mr. Morales was an employee of a tow truck company or if he was the owner of the truck he was fixing. Under the Occupational Safety and Health Administration (OSHA), employers are required to train employees in order to reduce workplace hazards. According to the Centers for Disease Control, there are some 5,800 people killed in work-related accidents every year including traffic accidents, chemical exposure, electrocutions, malfunctioning equipment, construction incidents, explosions, fires and falls.

?If you have been injured in a workplace accident consider hiring a lawyer to investigate the circumstances to determine if there was liability on the part of the employer,? said Attorney West Seegmiller, founder of the Seegmiller Law Firm. ?There are many circumstances that could lead to a person?s serious injuries at work including poor maintenance, inadequate lighting or security, as well as poorly trained or licensed employees.?

The families of those seriously injured or killed in an industrial workplace accident may make a claim under Workers Compensation to cover medical and funeral expenses as well as some salary payments, but in some cases they should consider a wrongful death claim. In cases where there was negligence involved the surviving members of a person?s family may also receive compensation for future income lost because of the untimely death as well as emotional distress and loss of companionship.
